Nōma Camera – Terms of Use

1. Acceptance

By downloading or using Nōma Camera ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not download or use the App.

2. License

Noma Software LLC grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on Apple-branded devices that you own or control, subject to these Terms and the Apple App Store Terms of Service.

3. Subscriptions and Purchases

3a. Free Trial

The App offers a 7-day free trial for new subscribers. The free trial provides full access to all App features. The trial automatically converts to a paid annual subscription unless cancelled at least 24 hours before the end of the trial period.

3b. Annual Subscription

Nōma Premium is available at $9.99 per year (USD). Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date. Payment is charged to your Apple ID account at confirmation of purchase and upon each renewal.

3c. Lifetime Purchase

A one-time lifetime purchase is available at $24.99 (USD). This grants permanent access to all features available at the time of purchase. The lifetime purchase is non-refundable except as required by applicable law or Apple's refund policies.

3d. Managing Subscriptions

You can manage and cancel your subscription at any time through your Apple ID settings: Settings → [Your Name] → Subscriptions. Cancellation takes effect at the end of the current billing period. You will retain access until the period ends.

3e. Refunds

All purchases are processed by Apple through the App Store. Refund requests must be submitted directly to Apple at reportaproblem.apple.com. Noma Software LLC does not process refunds directly.

3f. Price Changes

We reserve the right to modify subscription pricing at any time. Any price changes will take effect at the next renewal period. We will provide reasonable notice of price changes through the App or App Store.

4. Restrictions

You may not: (a) copy, modify, or distribute the App or its content; (b) reverse engineer, decompile, or attempt to extract the source code of the App; (c) use the App for any unlawful purpose or in violation of any regulations; (d) transfer your license or subscription to another person; (e) remove any proprietary notices or labels from the App.

5. Intellectual Property

All content, design, graphics, user interface, code, and film simulation recipes within the App are the property of Noma Software LLC and are protected by applicable intellectual property laws. All rights not expressly granted are reserved.

6. User Content

Photos captured with the App are your property. We do not claim any ownership over content you create using the App. As stated in our Privacy Policy, photos are stored locally on your device and are not uploaded to our servers.

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Noma Software LLC shall not be liable for any indirect, incidental, special, exemplary, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the App, even if we have been advised of the possibility of such damages.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Utah, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Utah.

10. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

11. Changes to Terms

We reserve the right to modify these Terms at any time. The "Last updated" date at the top of this page reflects the most recent revision. Your continued use of the App after any changes constitutes your acceptance of the updated Terms.
